These Terms of Service (“Terms”) govern your use of the CourtSide platform (“Service”), operated by Black Salt IT (ABN 63 660 450 564), Tasmania, Australia (“we”, “us”, “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
CourtSide is a netball scoring, statistics, and team management platform. The Service includes the web-based scoring application, admin portal, live scoreboard, enrichment tools, and associated APIs.
2. Accounts
- You must provide accurate information when creating an account, including your name and a valid email address.
- You are responsible for maintaining the security of your account credentials and for all activity under your account.
- You must be at least 18 years of age, or have the consent of a parent or guardian, to create an account.
- We may suspend or terminate accounts that violate these Terms or that remain inactive for an extended period.
3. Licences and Payment
- Access to scoring features requires a valid game licence. Licences are consumed per game and are non-transferable once consumed.
- Payments are processed securely by Stripe. We do not store your credit card details.
- Licence fees are as published on the Service at the time of purchase. We may change pricing with reasonable notice.
- Refunds are handled in accordance with our Refund Policy and the Australian Consumer Law (ACL).
4. Your Data
- You retain ownership of the game data, team information, and statistics you create using the Service.
- By using the Service you grant us a licence to host, store, process, and transmit your data solely for the purpose of providing and improving the Service.
- You are responsible for the accuracy of player and team information you enter. Avoid entering sensitive personal information (such as medical details or dates of birth) unless necessary for your use.
- We may generate aggregated, de-identified statistics from usage data to improve the Service. Such data will not identify individual users or players.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Interfere with or disrupt the Service or its infrastructure.
- Share game access credentials (share codes or PINs) beyond their intended recipients.
- Use automated tools to scrape, harvest, or extract data from the Service.
- Misrepresent your identity or affiliation with any team, club, or association.
6. Game Sharing
- The Service allows you to share live game access with scorers, enrichers, and scoreboard viewers via time-limited codes.
- Shared access expires automatically (customized by you). You are responsible for who you share access with.
7. Third-Party Services
- Payment processing is provided by Stripe and governed by the Stripe Services Agreement.
- We may integrate with third-party platforms in the future. Where we do, your use of those platforms will be governed by their own terms.
8. Availability and Support
- We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service is provided on an “as is” and “as available” basis.
- Scheduled maintenance will be communicated where practical.
- Support is available via email at help@getcourtside.com.au, Monday to Friday, 9am–5pm AEST.
9. Limitation of Liability
- To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
- We are not liable for any indirect, incidental, or consequential loss, including loss of data, revenue, or opportunity.
- Nothing in these Terms excludes or limits liability that cannot be excluded under the ACL or other applicable law.
10. Termination
- You may close your account at any time by contacting us.
- We may suspend or terminate your access if you breach these Terms, with notice where practical.
- On termination, your right to use the Service ceases. We may retain your data for a reasonable period to comply with legal obligations or resolve disputes, after which it will be deleted.
11. Changes to These Terms
- We may update these Terms from time to time. Material changes will be notified via email or a notice within the Service.
- Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Tasmania, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of Tasmania.
